The evidence around client money is being tightened
The SRA has consulted in two parts on client money in legal services, the second closing in February 2026. The proposals would require every accountant's report to be submitted, qualified or not, within six months of the period end; an annual declaration from firms holding client money; reports sent to the SRA and the compliance officer directly by the accountant; and fixed penalties for late or incomplete submission. A spot check of 596 firms found 25 that had not obtained a report at all and 31 that filed late. Whatever the final rules, the direction is towards evidence produced on time rather than assembled on request.
COFA accountability is being sharpened
The same consultation proposes that in larger or higher-risk firms, the person who unilaterally controls the firm cannot also hold the COFA role, with thresholds around £600,000 of turnover or £500,000 of client money held at any point. A separated COFA is personally accountable for a position they need to see daily, not at the next reconciliation.
